According to investigators, 18 February 2014 during the “riots” in Kiev Kostenko inflicted bodily injuries to Crimean employee of “Berkut” Special Forces. 24 March his case was transferred to the Kiev District Court of Simferopol.
15 May Kyiv District Court of Simferopol sentenced Kostenko to four years and two months of imprisonment.
Euromaidan activist did not recognize his guilt, Kostenko lawyer appealed to the Supreme Court of Crimea. The appeal has not been considered yet, the consideration is postponed constantly.
Kostenko is a citizen of Ukraine with Crimean residence permit, he did not receive a Russian passport personally. However, a copy of his passport as a citizen of Russia was added to the case on 28 January 2015. According to his lawyer, the original passport has not been seen yet.
Kostenko’s defense was not allowed to call for participation in the hearing the witnesses from mainland Ukraine.
The activist’s lawyer said that on the eve of sentencing Kostenko, who was in jail, was not fed, and was beaten and tortured. Kostenko suffers from health problems, he has injured back and arm.
Kostenko’s defense intends to complain to the European Court of Human Rights.
On February 26, lawyer Dmitry Sotnikov said that Kostenko needed immediate medical examination, but in annexed Crimea the appeal on the state of health was being ignored. “Who will tell me why the Kirov public supervisory commission does not exam the state of Kostenko? He did not have the proper medical care. Statement was sent and received. No answer”, said Sotnikov. The Presidium of the Russian Supreme Court considered the cassation from Kostenko’s defense and decided to reduce the sentence to 3 years and 6 months of the imprisonment. By this sentence he’ve got four years and two months.
On March 11, Olga Skrypnyk, Crimean coordinator of the human rights group, said that Kostenko was not allowed to send letters from Russian colony. “He says he receives letters not only from Ukraine, but also from other countries, however he cannot send it”, said Skrypnyk.
